Human Security Act of 2007 Sebagai Bentuk dari Perlindungan Hak Asasi Manusia dalam Upaya Kontra Terorisme di Republik Filipina

Abstrak - Selama bertahun-tahun, pemerintah Filipina menindak terduga teroris tanpa menggunakan undang-undang anti-teror. Ketiadaan tersebut menjadikan sulit untuk membedakan dalam menghukum teroris dan separatis. Sebagai respon atas pelanggaran hak asasi manusia yang dilakukan oleh pemerintah Filipina dalam menghukum para separatis secara tidak adil, maka PBB melakukan suatu investigasi. Investigasi tersebut akhirnya membuat Filipina sebagai salah satu negara yang dimonitor oleh PBB dalam kaitannya dengan hak asasi manusia. Akhirnya, badan legislatif Filipina membuat suatu undang-undang anti-teror yang dinamakan Human Security Act of 2007 (HSA). Undang-undang ini mengkodifikasikan tindakan-tindakan yang dapat dihukum sebagai kejahatan terorisme. Sejak dikeluarkannya HSA, muncul protes-protes yang menyatakan bahwa HSA sangatlah tidak jelas dan tidak adil dalam konteks hak-hak individual. Tulisan ini akan menganalisi mengenai kesamar-samaran HSA sebagai undang-undang anti-teror di Filipina dan bagaimana undang-undang tersebut menghormati tiap aspek-aspek dalam hak asasi manusia.

Abstract - For years, Philippines government prosecuted the terrorists without an anti-teror law. The absence make it difficult to distinguish between punishing terrorist and punishing secessionist. Responding to the violence of human right that have been done by the government of Philippines on punishing the secessionist un justly, the United Nation conducted an inverstigation. The invenstigation led to the placement of the Philippine government on the United Nation’s human rights watch list. The Philippine legislature, shortly thereafter, passed the Human Security Act of 2007 (HSA). This law codified the act punishable as crime of terrorisme. Since HAS has been issued, there were some complaints that HSA is very vague and unujust in the context of individual rights. This paper will analyze about the vagueness HSA as the anti-terror law in the Philippines and how it appreciate every aspects of human rights.
